Terms of Use

Nicholas

Written in plain English rather than lawyer, because a document you did not finish reading protects nobody. If something here is unclear, do not use this until it is not.

1. What this is

Nicholas is an automated crypto trading assistant for beginners. After you connect your Alpaca account, it places cryptocurrency trades only for you, using risk limits you control (position size, stop-loss, a daily circuit breaker). It never trades stocks, options, futures or anything else. It explains every box and every trade in plain words, so you learn as it trades. Nicholas never withdraws funds. You can disconnect it at any time from your Alpaca account.

Nicholas is in beta. It is unfinished software that can contain errors. Everything you do with it is entirely at your own risk.

2. It is not advice

Nothing produced by this software is investment advice, a recommendation, or a solicitation to buy or sell anything. The operator is not a registered investment adviser, broker, or dealer, and does not manage money on your behalf for compensation. You make your own decisions, including the decision to run this at all.

3. You keep the account, and the risk

4. No guarantee of results, no warranty, no liability

Nothing is guaranteed. The operator does not guarantee any result, profit, or that you will not lose money. Any numbers, simulations, backtests or examples shown anywhere are illustrations only, and results may vary.

This software is provided "as is" and "as available", in beta, without warranty of any kind, express or implied. The operator does not warrant that it will run continuously, without error, or profitably.

By accepting these terms you use Nicholas entirely at your own risk and release the operator, and anyone who works on or hosts Nicholas, from all liability and responsibility for any loss or damage of any kind, including losses caused by crypto markets, price moves, exchange or broker problems, outages, or software errors and bugs. To the maximum extent permitted by law, the operator is not liable for trading losses, lost profits, or any other damages arising from its use.

5. Your responsibilities

6. Ending it

You may revoke access at any time from your Alpaca dashboard, with no notice and no involvement from the operator — it takes effect immediately and the software simply stops being able to act. The operator may also stop running it for you at any time, for any reason, including not wanting to any more.

7. Changes

These terms may change as the software does. Continuing to use it after a change means you accept the current version.
